The case was heard by RYA Arbitration.
GBR 53959 was sailing downwind on port tack. 53959 gybed onto starboard and capsized with no damage occurring. GBR 53232 was sailing downwind on starboard and when 53959 capsized was 3 boats length from 53959. 53232 sailed close to 53959 and capsized next to her, putting a hole through 53959's mainsail and forcing her to retire.
Conclusion
GBR 53232 broke rule 22 and as a result GBR 53959's finishing position was made significantly worse, through no fault of her own, by the resulting physical damage. GBR 53959 is therefore entitled to redress under rule 62.1(b).
Decision
Redress granted. GBR 53959 is to be scored RDG with average points based on rule A10(a) for all races up to and including the day before the last day of racing (i.e. up till Thursday).
